The Madden NFL 24 is being very cavalier

If players decide to take part or not in the settlement plan, the issue heads back towards the Federal judge in Minnesota. If enough players choose to opt out the judge can decide to reconsider talks between parties, the league and the plaintiffs but there is no threshold for this to happen.

"It is important to reiterate that those who filed this suit and who currently do not support the settlement, rode to court under the banner of helping their disadvantaged brethren as well as those who had played in the N.F.L. yet today were penniless and, often, being afflicted by injuries or illness directly related their playing days. It is the height of disingenuousness for these same plaintiffs to complain of being like children who were denied dessert that the settlement "does not give enough benefit to the players who brought the lawsuit."

Participants who do not opt out of the settlement may then file individually against the league. They could be more encouraged to pursue this option given the latest developments in the O'Bannon vs. NCAA case, too as former college players are suing over their likeness to play video games.

In July In July, The Ninth Circuit threw out an appeal brought by the maker of video games EA Sports. The decision rejected the argument made by EA that the likeness of players were protected by the First Amendment and it will allow the appeal to proceed.
